Terms of Use

Version 2.1, effective August 27, 2026

These terms govern the public website cogni6.com and its public subdomains, including newsletter.cogni6.com and infolettre.cogni6.com, as well as communications, demo requests and, when Cogni6 invites you, a guided trial of limited duration and credits. They do not replace the written agreement governing a subscription, paid engagement or the processing of customer data.

1. Operator and contact information

The website is operated by Cogni6 inc., a corporation formed in Quebec, whose head office is at 134 chemin de la Tourterelle, Suite A, Stoneham-et-Tewkesbury, Quebec G3C 1N4, Canada. Cogni6 also operates an establishment at 805 rue Galt Ouest, Suite 304, Sherbrooke, Quebec J1H 1Z1, Canada.

2. Scope and acceptance

By browsing the website or using a public feature, you agree to the terms in effect at the time of that use. If you do not agree, do not use the website or its forms.

Some features may be subject to additional terms presented before use. If there is a conflict, the signed agreement or specific terms applicable to that feature prevail for their subject matter.

3. Eligibility and authority

The website is primarily intended for professionals and organizations. You must have legal capacity under the law of your territory. If you act for an organization, you confirm that you are authorized to bind it for the request you submit.

Anyone below the applicable legal age must not submit information through the website.

4. Nature of published information

Website content presents Cogni6 and provides general information. It is not legal, financial, tax, accounting, medical or other professional advice tailored to your situation. You remain responsible for your decisions and the validation required in your field.

Examples, scenarios, potential gains and descriptions of results do not guarantee a future outcome. Displayed capabilities may depend on configuration, context and the terms of a separate agreement.

5. Demo and guided trial

A demo request does not require Cogni6 or the requester to enter into an agreement. The presentation usually lasts 20 to 30 minutes and may use a real use case described by the requester, without submitting confidential information in the public form.

If the case is eligible, Cogni6 may offer a free guided trial. The trial may include workspace configuration, knowledge management training, support from the Cogni6 team and a limited bank of credits. Duration, scope, credits, authorized people and end conditions are confirmed in writing before access.

Cogni6 may decline, postpone or end a demo or trial in the event of security risk, prohibited use, insufficient capacity or a clear mismatch with the service.

A guided trial is not a commitment to general availability, data retention or a service level. Do not upload a customer file until you have received and accepted the applicable instructions and documents.

6. Separate product agreements

Purchase, subscription, deployment, support, service levels, billing and processing of data on behalf of a customer are governed by a separate service agreement. Where relevant, a data processing agreement, international transfer measures and security schedules are added.

Nothing on the website changes a signed proposal or agreement. If there is a conflict, the signed agreement prevails for the relevant service.

7. Acceptable use

You may use the website only for lawful purposes, in accordance with these terms and the rights of others.

  • Do not compromise, bypass, test without authorization or disrupt the security, integrity or availability of the website.
  • Do not introduce malicious code, automate abusive submissions, overload a service or bypass a technical limit.
  • Do not impersonate anyone, submit misleading information or use the website to defraud, harass or violate the law.
  • Do not scrape content at scale, reverse engineer website functionality or use our marks and content to train a model without written permission.
  • Do not submit information you have no right to disclose.

8. Your communications and confidential information

You retain ownership of what you submit. You grant us only the authorization needed to receive the request, respond, arrange a demo or meeting and protect the website.

Public forms are not intended for trade secrets, engagement data, highly sensitive information or privileged documents. Wait until an appropriate channel and terms have been agreed.

You confirm that your communications are accurate to your knowledge, lawful and non-infringing.

9. Intellectual property

The website, its design, text, illustrations, marks, software and organization are owned by Cogni6 or its licensors and protected by applicable law. Subject to these terms, Cogni6 gives you a limited, personal, revocable, non-exclusive and non-transferable permission to browse the website.

No right in the Cogni6 application, its code, methods, marks or content is granted by implication. Reproduction, adaptation, distribution, commercial exploitation or creation of derivative works requires written permission, except for a mandatory exception under the law.

10. Privacy and cookies

Our Privacy Policy explains the information processed by the website, providers, transfers, retention periods, cookies and your rights. It forms part of the website framework without reducing any right granted by law.

Analytics cookies are optional. You may decline them or withdraw your choice from the Privacy Policy.

11. Third-party services and links

The website may use or present third-party services, including for hosting, calendars, video conferencing, security, email and audience measurement. Their own terms may apply to their services.

A link to a third-party website is not an endorsement or guarantee. Cogni6 does not control the content or practices of an independent third party.

12. Availability, security and changes

We aim to maintain a reliable and secure website but do not guarantee continuous availability, freedom from error or compatibility with every device. Maintenance, an incident, a provider or an event beyond our control may temporarily interrupt a feature.

We may correct, change, suspend or remove a page or feature. We will not retroactively change a signed agreement through a website change.

13. Statutory warranties and disclaimers

To the extent permitted by law, the public website and its content are provided as is and as available, without implied contractual warranties of merchantability, fitness for a particular purpose, complete accuracy or non-infringement.

This disclaimer does not limit a warranty, remedy or liability that cannot be excluded under applicable law, including mandatory consumer rights.

14. Limitation of liability

To the extent permitted by law, Cogni6 is not liable for indirect, incidental, special, punitive or consequential loss arising from the public website, or for loss of profit, revenue, data or opportunity that was not reasonably foreseeable.

For a claim relating solely to the public website or a free demo, Cogni6’s total liability is limited to the greater of CAD $100 and the amount paid to Cogni6 for the activity giving rise to the claim during the preceding 12 months.

These limits do not apply to fraud, wilful or gross fault, bodily or psychological injury, or any liability that cannot be limited by law. A service agreement may provide a different regime for the product.

15. Indemnity for abusive business use

If you use the website for a business, you agree, to the extent permitted by law, to indemnify Cogni6 against a third-party claim directly caused by your unlawful use, intentional breach of these terms or content you had no right to submit. Cogni6 will give reasonable notice and allow you to participate in the defence.

This provision does not apply to a consumer where prohibited or to the extent Cogni6 caused the claim.

16. International access, exports and sanctions

You are responsible for confirming that access to and use of the website is lawful in your territory. You must not use the website in violation of applicable sanctions, export control or trade restriction laws.

Website availability in a country does not mean Cogni6 actively offers the product there, has an establishment there or agrees to provide a service there. A targeted offer may require local terms and measures before it becomes available.

17. Governing law and disputes

These terms are governed by the laws of Quebec and the federal laws of Canada applicable there, without regard to conflicts rules. The courts of the judicial district of Quebec have exclusive jurisdiction, subject to any mandatory rule where you live or jurisdiction the law does not permit the parties to exclude.

Before starting a proceeding, the parties will try in good faith to resolve the dispute by exchanging a sufficiently detailed written notice. This requirement does not prevent urgent relief, a regulatory complaint or a remedy that cannot be limited.

18. Changes, severability and language

We may change these terms for the future. The date at the top identifies the current version. A material change will be reasonably highlighted where it affects a feature in use and does not replace a signed agreement.

If a provision is invalid, it will be adapted or severed only to the minimum extent needed without invalidating the others. Failure to enforce a right is not a waiver. These terms, together with applicable notices and additional terms, form the agreement for the public website.

French and English versions are provided to support understanding. Subject to mandatory language rights, the parties have expressly requested that these terms and related documents be drawn up in French.
